All materials posted on the ACUHO-I Web site (www.acuho-i.org) and included in the ACUHO-I online library are subject to copyrights owned by the Association of College & University Housing Officers – International (ACUHO-I) and other individuals or entities. Any reproduction, retransmission, or republication of all or part of any document found on this site is expressly prohibited, unless ACUHO-I or the copyright owner of the material has expressly granted its prior written consent. All other rights reserved.

ACUHO-I Terms and Conditions of Use

The ACUHO-I Web sites, list serves, social network (www.acuho-i.net), blogs, and other electronic communication tools (the “Sites”) are made available to ACUHO-I members and the public as a service to quickly and conveniently share information about college and university housing. Users of these Sites are entrusted to behave in a professional manner and utilize them for the purpose in which they were intended. By using any of the Sites, you are agreeing to be bound by these terms and conditions of use. If you do not agree to be so bound, you may not use any of the Sites.

By accessing and/or posting within the Sites, each user agrees to the following terms and conditions:

  • Users may not post content that is illegal, obscene, defamatory, infringing on intellectual property rights, harassing, spoofing, threatening, or is otherwise objectionable. ACUHO-I reserves the right to edit and/or delete messages for any reason at its sole discretion and to ban users for any perceived infractions. Each user shall be entirely responsible for the content such user posts, uploads, emails or otherwise transmits to, from or on any of the Sites.
  • Opinions expressed within these areas are those of the individual authors and should not be construed as reflecting the opinions of ACUHO-I or its members or employees.
  • ACUHO-I will undertake reasonable efforts to present accurate information that it posts on its Sites. However, ACUHO-I cannot endorse, approve, or certify any information not provided directly by ACUHO-I (such as from a member), nor does it guarantee the accuracy, completeness, efficacy, or timeliness of such information. Each user must evaluate and bear all risks associated with the use of such information.
  • Reference to any commercial product, process, or service does not constitute or imply endorsement, recommendation, or favoring by ACUHO-I.
  • Material and messages posted must not violate the ACUHO-I Antitrust Policy (listed below). Any message deemed to do so will be removed as quickly as possible.
  • ACUHO-I Sites, list serves, social network, blogs, and other electronic communication tools may include links to other Internet Web sites and resources not created by ACUHO-I. These sites contain information created, published, maintained, or otherwise posted by organizations independent of ACUHO-I. ACUHO-I does not endorse, approve, certify, or control these external sites, nor any commercial product or service referenced therein, and does not guarantee the accuracy, completeness, efficacy, or timeliness of information located on these sites. · ACUHO-I assumes no responsibility for consequences resulting from use of the information contained herein or obtained at linked sites, and expressly disclaims all liability for damages arising out of use, reference to, reliance on, or performance of such information.
  • The Sites, list serves, social network, blogs, and other electronic communication tools may be changed and/or discontinued without notice and information contained within them may not be stored or archived.
  • EACH USER’S USE OF THE SITES IS AT THE USER’S SOLE RISK. THE SITES, THE INFORMATION CONTAINED THEREON AND ALL RELATED SERVICES AND RESOURCES ARE PROVIDED ON AN “AS IS”, “AS AVAILABLE” AND “WITHOUT WARRANTY” BASIS. ACUHO-I EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
  • Each user agrees to indemnify and hold ACUHO-I, and its subsidiaries, affiliates, members, service providers, and their respective directors, members, managers, officers, employees, agents and contractors, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of content such user provides, such user’s use of the Sites, such user’s violation of these terms and conditions, or such user’s violation of any rights of another person.
  • EACH USER UNDERSTANDS AND AGREES THAT NEITHER ACUHO-I, NOR ANY OF ITS MEMBERS, IS LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF ACUHO-I OR ITS MEMBERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, NEGLIGENCE OR OTHER TORT, STRICT PRODUCT LIABILITY, OR OTHERWISE), RESULTING FROM: THE USE OR INABILITY TO USE THE SITES OR THE INFORMATION THEREON; UNAUTHORIZED ACCESS TO OR ALTERATION OF A USER’S TRANSMISSIONS OR DATA; STATEMENTS OR CONDUCT OF ANY NON-ACUHO-I EMPLOYEE ON THE SITES; TERMINATION, SUSPENSION OR UNAVAILABILITY OF THE SITES OR ANY PART THEREOF; OR ANY OTHER MATTER RELATING TO THE SITES.
  • ACUHO-I, the ACUHO-I logo and other designated trademarks and service marks are trademarks or service marks of ACUHO-I. No user may display or use in any manner these ACUHO-I trademarks without ACUHO-I’S prior written permission. Other trademarks or service marks may belong to their respective owners and are protected by applicable law.
  • Each user agrees that the laws of Ohio shall exclusively govern these terms and conditions and any other issue arising between such user and ACUHO-I, without regard to any conflict of law provisions. Each user hereby agrees to submit to the personal and exclusive jurisdiction of the state or federal courts located in Franklin County, Ohio, for any dispute arising between such user and ACUHO-I. Each user hereby waives any claim or defense based on improper or inconvenient jurisdiction or venue.
  • ACUHO-I reserves the right to modify these terms and conditions at any time upon posting the updated terms and conditions on the Sites and/or by otherwise providing notice.

ACUHO-I Antitrust Policy

It is the policy of ACUHO-I to comply with all federal and state laws, including the antitrust laws. We recognize that the purpose of the antitrust laws is to prevent anticompetitive agreements and activities, thereby allowing the various competitive markets to operate without such restraints. Violations could include criminal penalties. Any actual or perceived violation by members may involve the Association in any investigation and/or litigation.

The following guidelines are provided to the members to reduce the likelihood of a violation of the antitrust laws and of the perception of a possible violation of the antitrust laws:

  • The members should limit their substantive discussions at Association meetings to the legitimate purposes of the Association.
  • Members are advised not to engage in any discussions – face-to-face, online, or otherwise – on any of the following topics:
    • Suggestions to exclude a competitor from membership or to terminate a current member for non-objective reasons, or for anticompetitive reasons.
    • Discussions about the individual competitive activities of any member or nonmember, whether those are past, present or future competitive activities.
    • Suggestions that a member should change certain competitive activities.
    • Suggestions of “targeting,” “pressuring,” or “suggesting” to a nonmember that the nonmember change its current or future marketing plans, products or activities.
    • Discussions regarding present or future marketing plans or products of any member and/or how that might impact competition among the members.
    • Discussions of any other competitive matters not specifically relevant to the legitimate purposes of the Association.
